Individual entrepreneur Aliaksei Charakhovich HireForYou.Pro (d/b/a HireForYou.pro) ("HireForYou.pro", the "Agency", "we", "us", or "our"), respect your right to privacy and strives to maintain the highest level of personal data protection. Therefore, in carrying our activities, we are committed to act in accordance with the laws and regulations that define the protection of personal data, the Electronic Communications Act and the EU General Data Protection Regulation. We prepared this Privacy Policy for Human Resource Purposes (hereinafter: the Policy) to provide information for respondents. The purpose of this Policy is to inform you of the purposes for which your personal data will be acquired and how they will be used, what are your rights in relation to the data we keep about you and how you can exercise them.

Individual entrepreneur Aliaksei Charakhovich HireForYou.Pro (d/b/a HireForYou.Pro), undertakes to use the collected personal data provided by you in accordance with this Policy, to not sell, lend or otherwise transfer your personal data to third parties, except in the cases defined in this Policy.

For the purpose of this Policy, "Personal Data" means any information relating to an identified or identifiable natural person as listed below.

We reserve the right to modify this Policy from time to time, so please review it frequently to see when this Policy was last revised. Any changes to this Policy will become effective when we post the revised version on our website. We will provide additional notice of significant updates. In case any modification deprives your rights of Sensitive Data in relation to this Policy, the Agency will first obtain your consent, except as otherwise permitted by law.


2. What personal data is collected

This Privacy Policy applies to:

  • employees at the employer,
  • potential candidates who applied for any vacancy published by the employer,
  • potential candidates who sent a job application via the Employment Form, on a Agency's website or in writing to the address of the Agency/via email, unrelated to the current job vacancies published by the employer and
  • non-selected candidates who have consented to the retention of personal data for future recruitment purposes.
Here is a summary of the Personal Data we collect:
  • your name, address, email address, telephone number, LinkedIn URL and include other similar information, social media accounts, identifiers in instant messaging platforms and other contact information;
  • any sensitive data obtained during the selection process such as gender, language proficiency, information about your nationality, immigration status, ID proofs, photograph;
  • your resume or CV, cover letter, previous work experience, education details, diplomas, training history, certificates and qualifications or other information you provide to us in support of an application;
  • details of the type of employment you are applying for, desired salary, willingness to relocate, or other job preferences and benefits;
  • details of how you heard about the position you are applying for;
  • information from interviews or assessments you may take as part for the screening or performance review process;
  • contact information about your references. It is your responsibility to obtain consent from referees before providing their personal information to us.
  • emergency contact information. It is your responsibility to obtain consent from your emergency contact before providing their personal information to us.

3. Purposes of Processing Your Personal Data

All personal data you provide to us will be treated confidentially and will be used only for the purposes for which they were provided. If there is a need for further processing of your data for any other purpose, we will contact you in advance and ask for your consent.

The purposes for which we may use your personal data are as follows:

1) contractual or pre-contractual basis, for our initiation or fulfillment of our employment agreement with you if you are an employee;
2) to be made available to the Agency's customers at the opening of the relevant vacancy;
3) legal obligation, for the fulfillment of our legal obligations;
4) legitimate interest, for the purpose of our legitimate interests and the legitimate interests of third parties;
5) vital interest, for preventing or suppressing a danger to a person's life, body, or health; and/or
6) public interest, for the performance of a task carried out in the public interest or for the exercise of official authorities.

When we retain your personal data for other open positions, we do this based on Article 6(1)(f) of the GDPR and in order to give you the possibility to work with us or with our customers in the future, even though we are currently unable to offer you a position.

We will delete your personal data as soon as it becomes clear that an offer of employment will not be made to you or is not accepted by you, unless we believe that you might be suitable for other future open positions and you have not objected to this, or unless we need to retain your personal data for the preparation, filing or defense of legal claims. If we retain your personal data for other open positions, we will not store your personal data for this purpose for longer than 3 (three) years since the last use of the data, with the exception of data that needs to be stored longer in accordance with applicable law.


4. What we do to protect your Personal Data

The Agency will take all necessary steps to ensure that proper security measures are taken to ensure that the personal data provided by you are protected, undertakes to regularly check the security procedures, as well as technical and organizational measures, taking into account the latest technological and technical developments. In order to prevent unauthorized access or disclosure of information, the Agency has established the following proper physical, electronic and managerial procedures for the protection and security of information: encryption, pseudonymization, firewalls, restricted access of persons to information received, the use of passwords and other appropriate measures depending on the situation. In addition, access to your personal information will be provided only to those employees, contractors and other third parties who have a business need to know. Such persons will only process the information provided in accordance with our instructions and will be subject to a confidentiality obligation.

We have put in place procedures to deal with any suspected personal data breach and will notify you and any applicable regulator of a breach where we are legally required to do so.


5. Transfer of your Personal Data

We may disclose or transfer your Personal Data to third parties or servers located overseas, which the destination countries may or may not have the same equivalent level of protection for Personal Data protection standards. We take steps and measures to ensure that your Personal Data is securely transferred and that the receiving parties have in place an appropriate level of data protection standards or other derogations as allowed by laws. We will request your consent where consent to cross-border transfer is required by law.

We rely on standard contract clauses for data transfers as a means of ensuring adequate protection when transferring data outside of the EU.


6. Use of Third-Party Service Providers

The Agency may engage third-party service providers, such as providers of recruiting software and applicant tracking system, e.g. Online recruitment automation service CleverStaff (Ukraine) and Google Workspace by Google LLC (USA), with whom Agency contracts as part of its normal business operations to carry out recruitment-related functions. HireForYou.Pro diligently selects such service providers and enters into written agreements with them ensuring that such providers (i) have adopted adequate data protection and security measures to safeguard your personal data; (ii) only use your data as instructed by HireForYou.Pro and for no other purposes; and (iii) store your personal data only within the terms of the agreement.

We require all third parties to respect the security of your personal data and to treat it in accordance with the law. We do not allow our third-party service providers to use your personal data for their own purposes and only permit them to process your personal data for specified purposes and in accordance with our instructions, including but not limited to, by entering into standard data protection clauses adopted by the European Commission.


7. Your rights as a data subject

Subject to applicable laws and exceptions thereof, you may have the following rights to:

Access: You may have the right to access or request a copy of the Personal Data we are collecting, using and disclosing about you. For your own privacy and security, we may require you to prove your identity before providing the requested information to you;

Rectification: You may have the right to have incomplete, inaccurate, misleading, or not up-to-date Personal Data that we collect, use and disclose about you rectified;

Data Portability: You may have the right to obtain Personal Data we hold about you, in a structured, electronic format, and to send or transfer such data to another data controller, where this is (a) Personal Data which you have provided to us, and (b) if we are collecting, using and disclosing such data on the basis of your consent or to perform a contract with you;

Objection: You may have the right to object to certain collection, use and disclosure of your Personal;

Restriction: You may have the right to restrict the use of your Personal Data in certain circumstances;

Withdraw Consent: For the purposes you have consented to our collecting, using and disclosing of your Personal Data, you have the right to withdraw your consent at any time;

Deletion: You may have the right to request that we delete or de-identify Personal Data that we collect, use and disclose about you, except we are not obligated to do so if we need to retain such data in order to comply with a legal obligation or to establish, exercise, or defend legal claims;

Lodge a complaint: You may have the right to lodge a complaint to the competent authority where you believe our collection, use and disclosure of your Personal Data is unlawful or noncompliant with applicable data protection law.


8. Your duty to inform us of changes

It is important that the personal information we hold about you is accurate and current. Please keep us informed if your personal information changes during your relationship with us. This is a requirement from a business continuity perspective so that in the event of an emergency your details are current.
